Terms of Service

These Terms govern your use of hivebizz.com and the Hivebizz application. By creating an account or using the service, you agree to them. If you are agreeing on behalf of a company, you confirm you have authority to bind that company.

1. The service

Hivebizz analyses landing pages using simulated AI personas. It generates synthetic profiles, walks them through your page section by section, and produces a report showing where simulated visitors disengaged, what objections they raised, and suggested fixes.

Hivebizz is operated by a sole proprietorship based in Bangalore, India.

2. What Hivebizz is not (read this section)

This is the most important thing to understand about the service.

• Personas are synthetic. They are not real people. Every persona, quote, and reaction in a report is generated by an AI model. No real human visited your page as part of a Hivebizz test.
• Reports are predictions, not measurements. A Swarm Score is a computed summary of simulated behaviour. It is not a conversion rate, a forecast of your conversion rate, or a measurement of anything that happened with real traffic.
• We do not guarantee outcomes. Implementing suggested fixes may not improve your conversion rate, traffic, revenue, or any other metric.
• Hivebizz does not replace real analytics or user research. Use it to find obvious problems before spending on traffic, then measure real results with real tools.

You agree not to present Hivebizz output to clients, investors, or anyone else as real user data or measured results.

3. Your account

• You must be at least 18 years old.
• You are responsible for activity under your account and for keeping access to your email secure, since we use magic-link and Google sign-in.
• One person or organisation per account. Do not share credentials to circumvent plan limits.
• Notify us at hello@hivebizz.com if you suspect unauthorized access.

4. Acceptable use

Full detail is in our Acceptable Use Policy, which forms part of these Terms. In summary, you must not:

• Submit URLs you have no right to test
• Use the service to attack, overload, or probe any website
• Submit pages behind logins, paywalls, or access controls you are not authorised to access
• Submit pages whose main content is personal data, illegal material, or content you do not have rights to
• Resell raw Hivebizz output as your own product (agency use, where you deliver reports as part of a service to your clients, is permitted and expected on the Agency plan)
• Attempt to extract our prompts, reverse engineer the persona pipeline, or scrape the service
• Use automated access outside our documented API

We may suspend or terminate accounts that violate this section, without refund where the violation is serious.

5. Your content and our content

Yours. You keep all rights to URLs you submit, page content you paste, and anything you upload. You grant us a limited licence to process it solely to deliver the service to you, and to keep it stored until you delete it.

Reports. The report generated for you is yours to use, share, and deliver to clients.

Ours. The Hivebizz software, persona pipeline, prompts, scoring methodology, Hex Funnel visual, brand, and site content remain ours. Nothing here transfers ownership of any of it.

Anonymized statistics. We may include aggregate, anonymized statistics derived from tests in benchmark features. This never includes your URL, your report content, or anything identifying you or your clients.

6. Plans, payment, and credits

• Plans and prices are listed at hivebizz.com/pricing and are in US dollars.
• Payments are processed by Lemon Squeezy, our merchant of record. Lemon Squeezy handles billing, invoicing, and applicable sales tax or VAT. Their terms apply to the payment transaction.
• Subscriptions renew automatically until cancelled. Cancel any time from your billing settings.
• Credits reset at the start of each billing period and do not roll over.
• Plan limits (tests per month, personas per test, concurrent tests) are enforced in the product.
• We may change prices with 30 days' notice. Changes never apply to a billing period already paid for.

7. Availability

We aim to keep the service running but do not promise any specific uptime. The service may be unavailable for maintenance, third-party outages, or reasons outside our control. We do not offer an SLA on any plan at this time.

A test may fail if a page will not load, is behind a login, blocks automated access, or renders content we cannot capture. Failed tests do not consume a credit.

8. Third-party services

The service depends on third parties including Anthropic, Supabase, Vercel, Render, and Lemon Squeezy. Their outages or changes may affect Hivebizz. We are not liable for their acts or omissions.

9. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We specifically do not warrant that reports will be accurate, that predicted behaviour matches real visitor behaviour, or that acting on our recommendations will produce any result.

10. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunities.
• Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the three months before the claim arose, or (b) fifty US dollars.
• We are not liable for decisions you make based on report output, or for how you or your clients use it.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and costs (including reasonable legal fees) arising from your use of the service, your violation of these Terms or the Acceptable Use Policy, or your submission of URLs or content you had no right to submit.

12. Termination

By you: delete your account at any time from settings, or email hello@hivebizz.com. Deletion is covered in our Data Deletion Policy.

By us: we may suspend or terminate your account for violation of these Terms, non-payment, or if required by law. For non-serious issues we will try to contact you first.

On termination, your right to use the service ends and your data is deleted per our retention schedule. Sections 5 (our content), 9, 10, 11, and 14 survive.

13. Changes to these Terms

We may update these Terms. Material changes will be notified by email at least 14 days before taking effect. Continued use after that constitutes acceptance. If you do not agree, cancel before the change takes effect.

14. Governing law and disputes

These Terms are governed by the laws of India. Courts in Bangalore, Karnataka, India have exclusive jurisdiction, except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings locally.

Before formal proceedings, both parties agree to attempt resolution by contacting hello@hivebizz.com in good faith.

15. General

• If any provision is unenforceable, the rest remains in effect.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these Terms. We may assign them in connection with a sale of the business.
• These Terms, plus the Privacy Policy, Acceptable Use Policy, Refund Policy, and Data Deletion Policy, are the entire agreement between us.
